Why Is Mehir Given?

Mehir (also known as mahr) is given to fulfill the financial right granted to the woman by virtue of marriage. As a result of the nikah (Islamic marriage ceremony), money, gold, property, or any other asset with economic value that the man is obligated to pay the woman can be designated as mehir.

One of the fundamental purposes of mehir is to provide the woman with an economic asset of her own. The mehir belongs entirely to the woman, and she may use it however she chooses. Mehir should not be thought of as a payment owed to the husband, his family, or shared household needs. The woman is not obligated to prepare a trousseau or cover wedding expenses in return for the mehir.

Mehir also serves to provide the woman with economic and social security. In particular, mehir set as a deferred payment can create savings or financial security that the woman can rely on in later years. That said, mehir is not merely a sum paid in the event of divorce. It can be paid promptly, on a deferred basis, or in installments over the course of the marriage.

Mehir is not a purchase price for the woman, nor a payment made in exchange for the marriage. In Islamic law, the nikah is not regarded as a contract of sale; mehir is an independent financial right that marriage grants to the woman.

When determining the mehir, the focus should not be simply on requesting a high amount, but on creating a realistic and fulfillable financial obligation. The amount, payment timing, and type of mehir should be discussed openly by the couple; if gold is chosen, the grams or number of pieces should be specified, and if money is chosen, the amount and currency should be made clear.
